Cost Control · Case CC-03

Regulatory Accretion and Compliance Cost Growth

Why the requirements only ever grow?

The regulatory load on the individual operation grows in one direction only, because adding a requirement is career-safe and removing one is not. Each addition was defensible when signed; the cumulative whole has never been examined by any institutional process, and the individual operation pays for it in money, time, and procedure.

If the requirements on your operation have only ever grown, that is not your impression; it is the institution's arithmetic. Nobody chooses the growth. Every official chooses the career-safe direction, and the sum of career-safe choices runs one way.

CC-03 · Finding
ADDITION: PERMANENT · SUBTRACTION: OCCASIONAL

Adding a rule creates a defensible artefact at near-zero career risk, its cost dispersed and attributable to no one. Removing one exposes the signing official if anything is ever attributed to the absence. The infrastructure of addition is permanent; subtraction's is occasional.

The cumulative state is an accretion, not a judgement: each rule was reviewed at signing, and no institutional process has examined the resulting whole at any point. That claim is falsifiable by any authority able to point to the process; none has been identified. The cost lands where there is no department to absorb it. In money: the recent avionics mandate reached 15 to 20 percent of hull value at the affordable end of the fleet, a proportion no institutional operator ever faces. In time: the administrative load lands on the same person who flies, maintains, and funds the operation. And in participation: procedural complexity is a barrier to entry that contracts the population and thins the ecosystem the remaining operators depend on. The mechanism travels with the institutional form itself; both major systems grow the same way.

Why it persists

The bias is the institution's own incentive function, and it will run until external pressure large enough to redirect it appears; none is visible at the required scale. The covers are three. Safety requires evolving requirements: true at the margin, silent on the cumulative case. The framework reflects deliberative judgement: it reflects accumulated additions, none examined against the whole. The framework is working: it works excellently for the institutional operators it is calibrated to, and the proposition quietly reads their record as if it were the individual operation's.

Individual additions are routinely justified, and this case concedes for its sensitivity test that every one was defensible when signed; the finding survives the concession, because it concerns the process rather than the rules. Subtraction does occur under sufficient external pressure, and BasicMed, MOSAIC and Part 21 Light are real and credited here. The framework also works well for the operator class it is calibrated to, whose outcomes are excellent.

What an operation can do about it

The Institute's recommendation, voluntary and with the compliance floor absolute, is a load discipline. Keep the account the institution does not: inventory your recurring compliance items and price them in money and hours. Choose the load at the planning stage, since the selection is available at full value exactly once, before the aircraft is chosen. Use the subtraction channels that exist. And never self-exempt.

Individual gain
a selectable load

The recurring regulatory load spans severalfold between lawful pathways; the operation that keeps the account can choose its exposure, once, at the planning stage.

Cumulative · the missing artefact
the unexamined whole

No process has examined the cumulative load; every operation-level account is a fragment of that examination, and their aggregate is the evidence any future subtraction will require.

Secondary benefit · Safety

The personal segment's accident record is dominated by workload and decision factors; a framework examined for subtraction would address that record more plausibly than further addition.

Bounded claims; the incentive audit, falsifiability condition, and honesty conditions are in the case paper, Section 7.
